Enforcement and Bankruptcy Law
As Tanışman Hukuk, we manage the process with a fast, disciplined, and document-focused follow-up system — from debt collection to debt restructuring, and from enforcement proceedings to bankruptcy and composition processes. Our goal is to prevent loss of rights, build a timely objection/injunction strategy, and move the file forward in a result-oriented way.
Our Scope of Services
Process and deadlines are critical in enforcement files. Getting the setup right from the start increases collection success and, for debtors, reduces the risk of unnecessary seizure/costs.
- Enforcement proceedings with and without a judgment: Initiating and conducting general attachment proceedings, judgment-based enforcement, eviction, and similar proceedings, and determining case strategy.
- Attachment proceedings specific to negotiable instruments: Proceedings arising from checks/promissory notes/bills, payment order processes, evaluation of objections, and management of the attachment stage.
- Debt collection and restructuring processes: Settlement negotiations, payment plans, securing collateral, drafting protocols, and safeguarding collection.
- Objections to enforcement proceedings and actions to cancel objections: Building an objection strategy, processes for removing/cancelling objections, and organizing evidence and documentation.
- Negative declaratory and recovery actions: Establishing that no debt is owed, recovering wrongfully collected amounts, injunction requests, and case management.
- Attachment, sale, and ranking-order procedures: Attachment implementation, sale procedures, valuation, ranking order, and follow-up of the distribution stage.
- Bankruptcy, composition, and liquidation processes: Composition applications, registering claims, commissioner processes, bankruptcy/liquidation procedures, and creditor/debtor-side strategy.
- Enforcement files for banks and financial institutions: Loan/collateral relationships, mortgage and pledge processes, bulk file management, and regular reporting.
How Do We Work?
We start by reviewing the documentary basis of the receivable/debt relationship (contracts, invoices, reconciliations, checks/notes, collateral) and determine the fastest, lowest-risk roadmap for the file. Throughout the process, we track deadlines meticulously and coordinate the attachment/sale and litigation stages.
Note: The most suitable method for each file is determined based on the documentation and the parties' positions.
