Construction Law

With our legal services for employers and contractors in the construction sector, we offer an approach that protects the employer's side and manages risks proactively — from the contract stage to progress payment processes, from occupational health and safety compliance to administrative dispute management.

Our Scope of Services

The legal risks faced by employers and contractors in construction projects are concentrated around contracts, progress payments, permits, and occupational safety. By structuring the process correctly from the outset, we aim to prevent cost and time losses.

  • Drafting and revising construction and works contracts: Risk analysis and structuring of penalty clauses and guarantee provisions in contractor-employer, subcontractor, and sub-supplier agreements.
  • Progress payment and entitlement disputes: Review of progress payment reports, objections to deficient/unjust deductions, and management of collection processes.
  • Occupational health and safety (OHS) compliance and objections to administrative fines: Advisory on OHS legislation compliance, inspection processes, and objections to administrative fines.
  • Employer defense following a workplace accident: Determination of fault ratio, expert witness processes, and defense strategy in cases concerning employer liability.
  • Management of subcontractor and sub-supplier relationships: Contract compliance, legal action in cases of work stoppage/delay, and termination processes.
  • Licensing, permit, and zoning processes: Follow-up of applications and objections relating to building permits, occupancy permits, and zoning legislation.
  • Tender processes and objections to tenders: Review of specifications in public and private sector tenders, and preparation of objections and complaint applications.
  • Letters of guarantee and termination disputes: Management of claims relating to final guarantee and advance payment guarantee refunds, and justified/unjustified termination allegations.

How Do We Work?

We start by reviewing the project contract, progress payment records, and the current dispute, drawing up a risk map from the employer's perspective. We then jointly pursue an objection strategy in administrative processes (OHS, permits, tenders) and a collection/litigation roadmap in commercial disputes.
